The Food Safety News Top 10 News Stories of 2013

Editor’s Note: Each year, the writers and editors of Food Safety News pick the top 10 news stories based on the story’s overall importance within the food safety community. This year, we’ve added a separate listing of the top 10 foodborne illness outbreaks, as compiled by managing editor James Andrews and published on Dec. 27th. Some of these outbreaks make a repeat appearance by also making the list of top 10 news stories. Drum roll, please: Here are the top 10 food safety news stories for 2013:


1. U.S. District Attorney for C olorado breaks new legal ground for food safety with successful prosecution of the Jensen brothers on multiple federal misdemeanor counts. Making rare use of a federal criminal statute, whereby convictions can be obtained based on strict liability without any need to prove intent to harm, district attorney John Walsh obtained guilty pleas from the Jensens with an agreement that will see the pair sentenced later this month. The brothers already participated in a precedent-setting meeting with outbreak victims. The case was a severe one, with as many as 43 direct and indirect deaths resulting from the 2011 Listeria outbreak linked to cantaloupes grown by the Jensens, and sets a precedent for similar charges in cases where adulterated food is released into interstate commerce.


2. Cyclosporiasis outbreak sickens 631 in 25 states but leaves investigators with multiple theories. The outbreak of this foodborne parasite also takes the title for most confusing, as it appeared to be two separate Cyclospora outbreaks working in tandem. One set of patients – predominantly from Iowa and Nebraska – clearly appeared to be connected to Olive Garden and Red Lobster outlets (both owned by Darden Restaurants), while, just weeks later, patients in Texas began cropping up with no apparent connection to those restaurants. The Darden illnesses were tentatively traced to lettuce supplier Taylor Farms de Mexico, but no contamination could be found at the farms. Meanwhile, many of the Texas illnesses seemed to implicate fresh cilantro grown in Puebla, Mexico. [CDC outbreak information]


3. Stewart Parnell and three other former Peanut Corporation of America executives charged with 76 federal felonies for conspiracy and fraud in connection with a peanut butter-related outbreak. After a Congressional inquiry in early 2009 alleged that Parnell knowingly shipped peanuts contaminated with Salmonella, an action that killed nine and sickened 700, his victims had to wait four years for investigators to make their case. But the indictments that came down in February 2013 were stunning – a complex criminal conspiracy case with food poisoning at its core. Convictions could carry long jail sentences and heavy fines. The trial is scheduled for later this summer.


4. Foster Farms outbreak (its second of the year) sickens 416 in 23 states with multidrug-resistant Salmonella Heidelberg, leaving consumers to ask, why no recall? While this outbreak appears to be ongoing, hundreds of individuals have fallen ill over the course of the year in connection with raw chicken processed at Foster Farms facilities in California. At least 162 people have been hospitalized after likely undercooking the contaminated raw chicken or handling it in a way that led to accidental cross-contamination. Foster Farms has refused to issue a recall, and cases continue to appear as recently as early December. [CDC outbreak information]


5. Costco, with Townsend Farms Organic Antioxidant Blend frozen juice, sickens 162 in 10 states and sends 71 to hospitals by serving up Turkish pomegranate seeds infected with Hepatitis A. [CDC outbreak information]


6. Dr. Elisabeth Hagen, USDA’s Under Secretary for Food Safety, departs, leaving the federal government without its top food safety official. After making her mark on USDA’s food safety record, Hagen departed just before 2013 came to an end. She will be remembered for increasing by six the number of E. coli strains classified as adulterants, updating Salmonella performance standards for poultry, issuing the first-ever standard for Campylobacter, and requiring labeling for mechanically tenderized meat. Her impressive run raises the bar for the president’s next appointment (and for the required U.S. Senate confirmation) to this important office.


7. Horsemeat scandal rocks the European beef market, which is the target of widespread fraud. In December 2012, the Food Safety Authority of Ireland reported that equine DNA was being found in beef products, and, from there, the horsemeat scandal spread across Europe. By February, four subsidiaries of ABP Food Group had been accused of supplying adulterated meat. They were Silvercrest in County Monaghan, Dalepak in North Yorkshire, Freshlink in Glasgow and ABP Nenagh in County Tipperary, Ireland. Burger King, with 500 outlets in the U.K., dropped Silvercrest as its beef supplier. The French government suspended the license of a processing company for knowingly selling horsemeat labeled as beef, which had resulted in frozen products sold by others containing 60-100 percent horsemeat. Substitution of cheaper horsemeat for beef was seen as classic food fraud rather than a food safety crisis; however, it brought stepped-up residual testing for the veterinary drug known as phenylbutazone, or “bute.” While specific testing found “bute” only at low levels posing little risk to human health, there was concern about potentially higher levels in horses from the U.S. slaughtered in Mexico and Canada for export to Europe. Another concern are horses from Romania with equine infectious anemia (EIA). Due to its many aspects, the horsemeat scandal is sure to carry over into 2014.


8. Meat inspectors were kept on the job during the partial federal government shutdown, while some U.S. Food and Drug Administration (FDA) inspections were slowed. The failure to enact legislation appropriating funds for fiscal year 2014, which began Oct. 1, brought another partial shutdown of the federal government. The shutdown began Oct. 1, with normal operations resuming Oct. 17. This time, however, there were no threats of pulling USDA meat inspectors from their jobs and thereby shutting down the industry. Likewise, FDA inspections were slowed, but not stopped, during the 16-day shutdown.


9. Another year passed without a new Farm Bill as the historic urban/rural coalition falls apart and the connection is broken between food stamps and farm payments. The 2008 Farm Bill was scheduled for renewal in 2012. It did not happen then, nor did it happen in 2013. This means that the legal authority for America’s farm and nutritional policies is wearing thin and will require quick action in 2014.


10. GMO labeling is voted down in Washington state. Just like California a year earlier, Washington state voters, by only a very slim margin, rejected a ballot initiative that called for labeling food and beverages containing genetically modified organisms (GMOs). Like California’s Proposition 37, Washington’s Initiative 522 started out with a massive lead in the polls that melted away during a heated campaign that saw GMO labeling proponents heavily outspent by major players in the food manufacturing industry.

CDC: Most Americans exceed recommended salt intake

A Centers for Disease Control & Prevention (CDC) report published in Morbidity and Mortality Weekly Report shows that sodium intake declined slightly during 2003–2010 in children ages 1–13 years, but not in adolescents or adults.

Milk may serve as a protective carrier of bioactive molecules

A study published in the Journal of Dairy Science shows that when epigallocatechin gallate (EGCG), the major extractable polyphenol in green tea and the most biologically active, is diluted in skim milk or other milk complexes, it remains bioactive and continues to reduce colon cancer cell proliferation in culture at concentrations higher than 0.03 mg of EGCG/mL.

Ferrous bisglycinate may prevent iron deficiency in pregnant women

A study published in the Journal of Perinatal Medicine shows that a low dose of ferrous bisglycinate (Aminojern, a product containing Albion’s Ferrochel) may be equivalent to a higher dose of ferrous salt with regard to hematological and iron status when used by expectant women.

Hummus Recalled for Possible Listeria Contamination

Spokane Produce is recalling approximately 59 pounds of Victor’s Sesame Hummus due to concerns about possible Listeria Monocytogenes.


The recalled product is labeled with UPC 6 09722 76501 5 and a best-by date of 12/29/13. The hummus was distributed to retail locations (Rosauers, Brewster Market, SuperOne) in Washington and Montana.


No illnesses have been reported in association with this recall.


The Listeria species were discovered during routine testing of the newly released product. The Listeria test used is an indicator of several species of Listeria and does not specifically indicate Listeria Monocytogenes.


Consumers who have purchased Victor Toasted Sesame Hummus are urged not to eat it and to dispose of it or return it to the place of purchase for a full refund.

Frozen, Raw Chicken Recalled For Possible Temperature Abuse

Palama Holdings, LLC, a Kapolei, HI establishment, is recalling approximately 3,600 pounds of raw, frozen marinated chicken products because they may have experienced temperature abuse in the distribution chain.


The products subject to recall are 10-lb. cardboard boxes, containing 4 individual cryovac sealed packages of May’s Hawaii “Hawaiian Style, Boneless and Skinless Teriyaki Chicken Thighs.”


The products were produced Oct. 15, 2013 and Nov. 5, 2013 then were distributed for retail sale in the Hawaiian islands of Oahu, Maui and Kauai and to a nearby military commissary. The packages bear the establishment number “EST. P-11077” in the USDA mark of inspection on the package.


The problem was discovered during shipment when the company’s distributor observed boxes of product swollen with gases from the bagged chicken, an indication that there may have been temperature abuse during storage prior to product distribution.


FSIS and the company have received no reports of adverse reactions due to consumption of these products. Anyone concerned about a reaction should contact a healthcare provider.

FDA extends comments deadline on artificial trans-fat decision

Thai-Style Soba Noodle Salad

Soba noodles, made from whole grain buckwheat, have a great bite, but if you overcook them they can get unpleasant quickly. Kokkoh (Macrobiotic Rice Milk)

Kokkoh is used as an infant formula broth made from whole grains, seeds and legumes lightly toasted and ground to a powder(in this recipe using brown rice only). It was first brought to Western culture by Sakura Nyoichi, better known as George Ohsawa, as part of the Macrobiotic Diet, based a recipe widely used in traditional Japan and most commonly eaten as a breakfast cereal. From cafemom. Kokkoh is recommended as both a substitute for mother's milk and a means of weaning infants from it. (In the former case the recipe often calls only for brown rice ground to a fine powder and water.) Besides its soft and easily digestible texture, kokkoh is recommended as such because its mixture has a high and varied protein content; combined, the amino acids in each of the ingredients described at the outset include virtually all those needed for consumption. It is thus especially well suited for the growth needs of a child. When used solely for weaning, it is recommended that kokkoh be introduced at between 8 months and a year of age. It may be used as breast milk substitute as early as five months, but with a larger proportion of water, in order to further dilute the mixture. Kokkoh is also an important part of the macrobiotic diet, in accordance with the diet's heavy emphasis upon grains. Along with its use as a means of weaning, kokkoh is a common breakfast food among macrobiotic eaters of all ages.

Spanish-Ish Adobo Chicken

I've modified this traditional Spanish/Portuguese method of cooking chicken by including one key ingredient of the Filipino-style adobo - soy sauce, because I feel that it completes the savory profile of the dish. This dish is best done low and slow to let the broth condense and to let the chicken become fall-apart tender. The leftovers go great on tacos or made into soup. It's also a low-calorie, low-fat dish, so it's great for weight-watchers!

Chinese Take-Out: Chinese Five Spice Powder

Here is a recipe so that you can make your own "Chinese Five Spice Powder" at home. It is much fresher and a lot tastier than the store bought bottles. Please feel free to adjust the quantity of each ingredient to your own liking and leave me a note as to your changes (I'm still playing with the ingredients myself). This keeps quite fresh for 4-6 months if stored properly. I double this batch each time so I do not have to make it as often. I'm kinda guessing at the yield size, as I have never really measured it after grinding. I hope you enjoy this recipe.

Missouri Meat Processor Recalls Beef and Pork Products for Possible E. Coli

Cloud’s Meats, Inc., of Carthage, MO, is voluntarily recalling beef and pork products that may possibly be contaminated with E. coli after positive test results in samples of items produced in mid-November.


According to a Dec. 2 news release, the samples were taken during routine testing conducted by the Missouri Department of Agriculture’s Meat and Poultry Inspection Program on Nov. 14 and analyzed by the Department’s Veterinary Diagnostic Laboratory in Springfield.


The Jasper County meat processor is voluntarily recalling approximately 1,450 pounds of meat, including ground beef and pork, sausage and steaks. The recalled products are marked with the code “318” and labeled with Clouds Meats Inc. or Cloud’s Smoked Meats.


Recalled items include 1,052 pounds of ground beef, 158 pounds of pork sausage, 152 pounds of ground pork, and 96 pounds of tenderized minute steak and tenderized round steak.


Company records indicate that the products were not listed as distributed for retail sale. However, anyone who may have the products listed above should return any unused portion to the business at 2013 S. Paradise Lane in Carthage.


Anyone concerned about an illness should contact their health-care provider.


Food contaminated with E. coli O157:H7 may not look or smell spoiled but can still make you sick. Symptoms can include nausea, vomiting, mild to severe abdominal cramps, and watery to bloody diarrhea. In severe cases of illness, some people may have seizures or strokes, need blood transfusions and kidney dialysis, or live with permanent kidney damage. In severe cases, the illness can be fatal.

Iowa Company Recalls Smoked Uncured Ham for Insufficient Labeling

Mary Ann’s Specialty Foods of Webster City, IA, is recalling approximately 3,536 pounds of Niman Ranch Applewood Smoked Uncured Petite Ham because the establishment number was not included on the label, the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced on Wednesday.


The following products are subject to recall:



  • Various weight packages of “Niman Ranch Applewood Smoked Uncured Petite Ham,” bearing the following identifying use by/ freeze by dates: “2/5/2014,” “2/10/2014,” “2/11/2013,” and “2/13/2013.”


The package covered by the recall may lack the establishment number “1221W” inside the USDA mark of inspection or elsewhere on the label. Although the producing establishment number was not included, which is a regulatory requirement, the distributor information was available. The products were distributed to retail stores nationwide. These products were produced between Oct. 23-31, 2013.


The problem was discovered by FSIS inspection personnel during routine label verification and may have occurred due to a printing error.


FSIS routinely conducts recall effectiveness checks to verify that recalling firms notify their customers of the recall and that steps are taken to make certain that recalled product is no longer available to consumers.

CA Firm Recalls Bolognese Sauce Products for Undeclared Allergen, Misbranding

DelMonaco Specialty Foods of Morgan Hill, CA, is recalling approximately 5,616 pounds of Armanino brand Bolognese sauce products because of an undeclared allergen and misbranding, the U.S. Department of Agriculture’s Food Safety and Inspection Service (FSIS) announced Friday.


The product contains milk, a known allergen, which was declared on the product label; however, the label was not applied to all the products in each lot.


The Bolognese Sauce with Beef & Pork products were produced on Sept. 25, Sept. 27, and Nov. 7, 2013. The following products are subject to recall:



  • 7.5-pound cases containing 12 10-ounce bags of “Bolognese Sauce with Beef & Pork” with case number 31113 printed on the interior bag.

  • 7.5-pound cases containing 12 10-ounce bags of “Bolognese Sauce with Beef & Pork” with case number 27013 printed on the interior bag.

  • 12-pound cases containing four 3-pound bags of “Bolognese Sauce with Beef & Pork” with case number 31113 printed on the interior bag.

  • 12-pound cases containing four 3-pound bags of “Bolognese Sauce with Beef & Pork” with case number 26813 printed on the interior bag.


The products subject to recall are missing the USDA mark of inspection with establishment number “EST. 17702” inside. These products were sold for institutional use in Hayward and San Francisco, CA.


The problem was discovered by a company customer. FSIS and the company have received no reports of adverse reactions due to consumption of these products. U.S. food recalls drop in Q3

According to ExpertRECALL, the U.S. Food and Drug Administration (FDA) Enforcement Reports documented 252 food recalls in the third quarter of 2013, representing a 14% decline over the previous quarter.

Pilgrim’s Pride announces plant restructuring

Pilgrim’s Pride Corp. has announced several operational changes. Effective Jan. 24, 2014, Pilgrim’s will expand its operations in Russellville, Ala., and Douglas, Ga., to absorb the current fresh poultry processing operations in Boaz, Ala.

The American Farm Bureau Federation’s 28th annual informal price survey of classic items found on the Thanksgiving Day dinner table indicates the average cost of this year’s feast for 10 is $49.04, a 44-cent price decrease from last year’s average of $49.48.

Spicy Chicken in Peanut Sauce With Noodles

This is my families favorite dish. Easy, healthy, and fast to make - you can use any type of meat, fish or seafood or firm tofu. Fool around with the quantities and ingredients till you get exactly what you want. You can use coconut milk, tomato sauce, or plain yogurt (with yogurt avoid vinegar and/or citrus juice). I use too little pepper and soya and let people add them at the table. You can garnish with peanuts, cashews, and/or green onions.

Black Widows Found in Supermarket Grapes in Several States

Supermarket chain Aldi pulled its entire stock of grapes from Milwaukee, WI, stores earlier this month after a shopper found a live black widow spider in a container of red grapes purchased from Aldi’s Wauwatosa, WI, store.


Similar occurrences have happened in recent months in Michigan, Missouri and Minnesota.


The Michigan incident happened just days prior to the one in Wisconsin, with a family finding the live spider in a bag of red grapes after taking it home from a Kroger store in Brighton, MI.


Two more black widows were found in containers of red grapes at an Aldi store in St. Louis in early October. In September, a black widow was reportedly found in a shipment of grapes at a Maplewood, MN, school.


Aldi has said it will implement additional inspection procedures at its warehouses and stores in hopes of preventing any further problems.


In the early 2000s, three customers complained of finding black widow spiders in their grapes purchased from Tesco supermarkets in the United Kingdom. The grape grower said it had begun using spiders on their vines as an alternative to pesticides.


The black widow is the most venomous spider in North America, though it only kills around 1 percent of those it bites. Small children and the elderly are most susceptible to the black widow’s venom.


Those who encounter a black widow are advised not to handle it, but instead capture it in a container and set it free outside. While the spiders are not aggressive, they will bite in self-defense.


The spiders are most easily identifiable by their long, shiny black legs and a reddish hourglass mark on their abdomens.


Symptoms of black widow bites may include nausea, muscle aches and difficulty breathing. Anyone who suspects they have been bitten by a black widow is advised to apply ice to the bite and seek medical attention to receive anti-venom.

Head, Dept. of Food Science at the University of Massachusetts, explains that this proposed rule is not without consequences to many individuals so it is critical that this decision is made carefully.

Asian Chicken Nuggets

I had these at a chinese buffet and they were really good! I found this recipe on the smokey wok website and am putting it here for safekeeping. "It's time for some home-made nuggets! These chicken nuggets are extremely versatile and can be served as hors d'oeuvre, part of a main dinner or simply as snacks. I call these nuggets Asian as I used Asian seasoning for the marinade while the ginger and the green onions in the batter completed the Asian flavours. Although I am not a huge fan of fried foods, these nuggets suit me a little better as the batter is lighter in that corn flour and egg whites are used. The finely chopped green onions and minced ginger in the batter provide extra fragrance to every crispy bite too. I served these with rice, but these also taste great served atop soupy noodles."
